I. In accordance with the letter of the Pingtung County Government dated May 15, 114 (2025), No. 1145082578.
II. According to Article 26 of the Statute Governing Relations Between the People of the Taiwan Area and the Mainland Area, Paragraph 3 of Article 70 and Article 72 of the Act Governing Retirement, Resignation, and Severance of Public Functionaries (hereinafter referred to as the "Retirement Act"), and Article 13 of the Regulations Governing the Verification and Disbursement of Periodic Retirement Benefits for Public Functionaries (hereinafter referred to as the "Verification Regulations"), retired public functionaries who receive monthly retirement benefits (or concurrently receive them) and reside in the Mainland Area for an extended period shall apply to the competent authority to change to receive a lump-sum retirement benefit. Those who fail to apply for a lump-sum retirement benefit as required,
those who receive preferential interest on savings, and dependents who receive survivor annuities or monthly pensions, if they have "registered household registration" in the Mainland Area or hold a Mainland Area passport, shall have their rights to receive monthly retirement benefits, preferential interest on savings, survivor annuities, and monthly pensions suspended. These rights shall be restored retroactively after they are permitted to re-establish their status as residents of the Taiwan Area.
III. Further, according to the aforementioned letter of the Mainland Affairs Council dated April 22, 114 (2025) and its order No. 1140400361 dated April 16 of the same month, the term "registered household registration" as used in Article 9-1 of the Statute Governing Relations Between the People of the Taiwan Area and the Mainland Area shall include holding a "residence permit" and "resident identity card" issued by the Chinese Communist Party. Therefore, the interpretation of "registered household registration" as used in the Retirement Act and the Verification Regulations shall be handled in accordance with the said letter and order.
IV. To prevent retired personnel from falling under the circumstances where periodic benefits should be suspended as stipulated in the aforementioned regulations, please inform colleagues within your agency (school) and notify retired personnel that they must proactively report any such situations. If there are any instances of overpayment of periodic benefits, recovery shall be handled in accordance with Article 70 of the Retirement Act and Article 16 of the Verification Regulations.
